HB 2287: firearm discharge; mental state; applicability

Summary: This bill changes the culpable mental state from “criminal negligence” to” knowingly or recklessly” for the offense of unlawful discharge of a firearm. The bill also reduces the distance a person must be from an occupied structure if discharging a firearm from one mile to ¼ of a mile for purposes of the current exception to the statute.

League Position: OPPOSE - The League opposes changes to “Shannon’s Law” that endanger public safety.
