HB 2499: facilities relocation; public utility easements

Summary: This bill requires cost reimbursement for facilities in a Public Utility Easement (PUE) if the utility was relocated from a PUE into the right-of-way (ROW) and a city project relocates them out of the ROW. It requires cities and towns to pay for the relocation costs in these specific circumstances unless an existing license or franchise provides otherwise. The utilities have requested language that will require cities to provide equal land rights in the location of the new facilities. The bill also adds definitions of right-of-way and public utility easement among others.
